Agreement
These Terms and Conditions ("Terms") govern your use of www.barkwitness.com (the "Site") and your purchase and use of Bark Witness products. The Site and products are provided by Novico, LLC ("Bark Witness," "we," "us"). By using the Site or our products, you agree to these Terms. If you do not agree, do not use them. You must be at least 18 to buy a product.
Use of the Site
You may use the Site for lawful, personal, and business purposes. You agree not to:
• Break any law or infringe anyone's rights
• Interfere with the Site's security or operation, or try to gain unauthorized access
• Scrape, copy, or reverse engineer the Site or our products, except as the law allows
• Submit false information or impersonate anyone
We may suspend or end your access to the Site at any time if you break these Terms.
Products and the beta program
• Orders. All orders are subject to acceptance and availability. We may refuse or cancel an order, and will refund any payment for an order we cancel. Payments are processed by our third-party payment processors.
• Pricing. Prices and product descriptions may change without notice. We try to keep them accurate but may correct errors.
• Beta program. Beta units are limited, offered for evaluation, and sold only to approved customers in the contiguous 48 United States. They may contain defects, change over time, or lack features of the final product. We may ask for your feedback, and we may use any feedback you give without obligation to you.
• Returns and warranty. You may return a beta unit within 30 days of delivery for a full refund, no questions asked. Email info@barkwitness.com to start a return. Apart from this return policy, beta units are provided without warranty.
Your responsibilities when using the device
The Bark Witness device records audio with time and GPS stamps. You are solely responsible for how you use it and the recordings it makes. You agree to:
• Follow all laws on audio recording, eavesdropping, and privacy where you use the device.
Some places require consent from people whose conversations are recorded.
• Place the device only where you have the right to do so.
• Use recordings only for lawful purposes, and not to harass, threaten, or defame anyone.
Recordings and reports are provided as information only. We do not guarantee that they will be accepted by any HOA, landlord, court, or law enforcement agency, or that they will resolve any dispute. Bark Witness does not provide legal advice.
Intellectual property
The Site, the Bark Witness name and logo, and the device's software and design are owned by Novico, LLC or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable right to use the device's software only with the device. You may not copy, modify, or distribute our content or software without our written permission. Recordings you make belong to you.
Disclaimers and limitation of liability
Except as stated in a written warranty, the Site and products are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the device will detect every sound, or that it will classify sounds without error.
To the fullest extent the law allows, Bark Witness will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim is limited to the amount you paid us for the product involved. Some jurisdictions do not allow these limits, so they may not apply to you.
Indemnification and governing law
You agree to defend and indemnify Novico, LLC and its owners, employees, and agents against any claims, losses, or costs, including reasonable attorneys' fees, arising from your use of the device or recordings, or your breach of these Terms.
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Salt Lake County, Utah, and you consent to their jurisdiction.
Changes, privacy, and contact
We may update these Terms from time to time. We will post the new version on this page and change the "Last updated" date. Continuing to use the Site or products means you accept the changes. If any part of these Terms is found unenforceable, the rest stays in effect.
